Article 2 – Applicability
These terms and conditions apply to every offer made by Livovista and to every distance contract concluded between Livovista and the consumer. Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer.
Article 3 – The Offer
Every offer contains sufficient information to make clear to the consumer what rights and obligations are attached to accepting the offer. The offer contains a complete and accurate description of the products offered. Errors or mistakes in the offer are not binding on Livovista.
Article 4 – The Agreement
The agreement is concluded when the consumer accepts the offer and fulfils the conditions set therein. Livovista will confirm receipt of acceptance by email. Livovista may investigate whether the consumer can meet their payment obligations. If Livovista has reasonable grounds not to enter into the agreement, it is entitled to refuse an order or request.
Article 5 – Right of Withdrawal
The consumer has the right to cancel the agreement within 14 days without giving reasons. The withdrawal period expires 14 days after the day on which the consumer, or a designated third party, takes physical possession of the product.
To exercise the right of withdrawal, the consumer must notify Livovista via contact@livovista.nl. The consumer may use the model withdrawal form but is not required to do so.
The consumer must return the goods as soon as possible, and no later than 14 days after notifying Livovista of the decision to withdraw. The direct cost of returning the goods is borne by the consumer.
Livovista will reimburse all payments received, including delivery costs, no later than 14 days after receiving and inspecting the returned goods.
Article 6 – Delivery
Delivery is available within the Netherlands only. The delivery time is 3 to 5 working days after receipt of payment, unless otherwise stated. Livovista aims to deliver within the indicated timeframe. In the event of a delay, the consumer will be informed as soon as possible.
If delivery of an ordered product proves impossible, Livovista will inform the consumer within 30 days and refund any amount already paid.
Article 7 – Payment
Livovista accepts payment via iDEAL, credit card, and bank transfer. Orders are processed upon receipt of full payment. Livovista uses a secure payment environment and does not store payment details.
Article 8 – Warranty and Conformity
Livovista guarantees that products conform to the agreement, the specifications stated in the offer, reasonable standards of quality and fitness for purpose, and applicable legal requirements at the time the agreement was concluded. The statutory warranty period is 2 years.
Article 9 – Complaints
Complaints about the execution of the agreement must be submitted to Livovista at contact@livovista.nl as soon as possible, with a complete and clear description. Complaints received by Livovista will be answered within 14 days. If a complaint requires a longer processing time, Livovista will acknowledge receipt within 14 days.
Article 10 – Disputes
Agreements with Livovista are governed exclusively by Dutch law. Disputes may be submitted to the competent court in the district of Livovista’s registered office. Consumers may also use the European ODR platform: https://ec.europa.eu/consumers/odr.
